The content and scope of data processing primarily depend on the services you have requested or agreed upon with us. For readability, gender-specific differentiation has been omitted in this document. Corresponding terms apply equally to all genders.

Which data is processed and its sources
We process the personal data that we receive from you in the course of the business relationship. In addition, we process data that we lawfully receive from credit agencies, debtor directories (e.g., Compass Verlag, KSV 1870), and publicly accessible sources (e.g., commercial register, association register, land register, media).
Personal data includes in particular your personal details (name, address, contact details, date and place of birth, nationality, etc.), identification data (e.g., ID data), and authentication data (e.g., signature sample). In addition, this may also include order data (e.g., payment orders), data from the fulfillment of our contractual obligations (e.g., turnover data), information about your financial status (e.g., creditworthiness data), marketing and sales data, documentation data (e.g., meeting protocols), registry data, image and sound data (e.g., video or telephone recordings), processing results we generate ourselves, as well as data for fulfilling legal and regulatory requirements.
Purpose and legal basis
We process your personal data in accordance with data protection law.
To fulfill contractual obligations (Art. 6 para. 1 lit. b GDPR)
Processing personal data (Art. 4 para. 2 GDPR) is carried out to provide financial services, in particular for the execution of our contracts with you and the fulfillment of your orders, as well as all activities required for the operation and management of a financial services institution. The purposes of data processing are primarily based on the specific contract content and may include, among other things, needs analyses, consulting, asset management and support, as well as the execution of transactions.
To fulfill legal obligations (Art. 6 para. 1 lit. c GDPR)
Processing of personal data may be necessary to fulfill various legal obligations (e.g., Financial Market Anti-Money Laundering Act [FM-GWG], etc.) as well as supervisory requirements (e.g., Austrian Financial Market Authority, etc.) to which SOL Capital Management GmbH is subject. An example of such a case: reporting to the Money Laundering Reporting Office in certain suspicious cases (§ 16 FM-GwG).
Based on your consent (Art. 6 para. 1 lit. a GDPR)
If you have given us consent to process your personal data, processing is carried out only in accordance with the purposes and scope specified in the consent declaration. Consent can be revoked at any time with effect for the future (e.g., you may object to the processing of your personal data for marketing purposes if you no longer agree to such processing). Please submit the revocation in writing either by email or post. The lawfulness of processing based on consent prior to revocation remains unaffected.
To protect legitimate interests (Art. 6 para. 1 lit. f GDPR)
Where necessary, processing may occur beyond the fulfillment of the contract to protect the legitimate interests of SOL Capital Management GmbH or a third party. In the following cases, data processing is carried out to protect legitimate interests:

- Measures for business management, further development of services and products, and customer retention
- Measures for fraud prevention and combat

Who receives the data?
Within SOL Capital Management GmbH, only those departments or employees receive your data who need it to fulfill contractual, legal, and supervisory obligations. If there is a legal or supervisory obligation, public authorities and institutions (e.g., Austrian Financial Market Authority, tax authorities, etc.) may be recipients of your personal data.
Regarding the transfer of data to other third parties, SOL Capital Management GmbH is obliged to maintain confidentiality regarding all client-related information and facts entrusted or made accessible to us due to the business relationship. We may therefore only share your personal data if you have consented in advance or if we are legally or regulatorily obliged or authorized to do so. Recipients of personal data may include other credit and financial institutions or comparable entities to which we transfer data to conduct the business relationship with you (depending on the contract, e.g., correspondent banks, stock exchanges, custodian banks, credit agencies, etc.).
Retention of data
We process your personal data, as required, for the duration of the entire business relationship (from initiation, execution to termination of a contract) and beyond, in accordance with statutory retention and documentation obligations arising, among others, from the Austrian Commercial Code (UGB), the Federal Tax Code (BAO), and the FM-GwG. Additionally, statutory limitation periods must be considered, which, for example, under the Austrian Civil Code (ABGB), may in certain cases extend up to 30 years (general limitation period is 3 years).
Data protection rights
You have the right at any time to access, correct, delete, or restrict the processing of your stored data, the right to object to processing, and the right to data portability under the conditions of data protection law. If you believe that we are processing your data in violation of data protection law, please contact us to resolve your concerns. Complaints may also be directed to the Austrian Data Protection Authority, 1030 Vienna, Barichgasse 40 – 42 (www.dsb.gv.at).
Obligation to provide data
In the context of the business relationship, you must provide the personal data required to establish and conduct the business relationship and whose collection we are legally obliged to carry out. If you do not provide this data, we may have to refuse to conclude the contract or execute the order, or a current contract may no longer be carried out and may consequently be terminated. However, you are not obliged to consent to the processing of data that is irrelevant for the performance of the contract or legally and/or regulatorily not required.
